Open Letter to Direct TV - Warning to Consumers

1st off, I work a lot. My wife takes care of all our bills and unless something is seriously different than what it was last week, she just pays and goes about being a mom.

I am not making any excuses for my not knowing some of this. Maybe if I were not so trusting, I would know some of it. Either way, it’s ridiculous.

That said, here is my problem with DirectTV.

Update: I sent a letter to the CEO of Direct TV and got a call from someone from his office. What I learned is at the bottom of the story…

Back in late 2005, I chose to give Direct TV a whirl against the advice of others. I had heard about the issues that are inherent to satellite. Well, I answered an ad that offered a TiVo receiver and 3 additional rooms and installation free. This went down fine. I was pleased with the service and didn?t really have any of the issues that friends told me about. I was aware that I was locking in to a 2 year contract. More than a year of happy service goes by and I bought a big HD TV so I decided to give Direct TV HD a try.

November 2006, I answered another ad in a circular that offered ?Free HD Receiver? with installation. I don?t remember if this was to ?bump? my contract to a new 2 year deal, but since have learned that it had. No biggie, I got a free receiver, so I accept that a contract is in order. Still, I am almost 100% happy at this point. We have started seeing some nasty signals sometimes with wind and definitely with rain. I keep trying to get around to finding out how to get someone out to readjust the dish since that is most likely what the problem is.

October 2007, I decide I want a DVR for HD. ( the receivers were out of stock when I got HD in 2006 or I would have ?PAID? for the receiver then) I went down to Circuit City and plopped down $299 of my own dollars to get an HD DVR. I take it home and install it. Called to activate it. Now my kids are happy to record hours and hours of crap, even better, I can record what I want to watch. J Everything seemed fine.

Last month, I received a box from Direct TV. I didn?t order anything so I called and asked what the heck this was. ?It?s an empty box to return the receiver?, I was told. HUH? The free receiver I got when I signed up for HD? ?Yes?. What the heck? How can I be asked to return something I was led to believe I OWNED. Anyhow, I am quite busy and didn?t get around to sending it back against my belief that it is my receiver.

Fast forward to last week. I mentioned that my wife only questions bills when they are different. Well, this one went from $100 to $337.80. That threw me off the deep end. I said, give it here and I will see what?s up. The cost was $240.00 for this HD Receiver I was supposed to own. That bothers me terribly, but that was only bomb #1. Bomb #2 was the fact that I had been charged $4.99/mo to lease this receiver that the ad told me was free. Hmmm? Fishy.

I call the 1-800 number, find out that I was misled and asked to have my service canceled. I was more than willing to a) pay a year of cancellation (11 months) and sell my HD DVR that I purchased for $299 at circuit city on ebay to recover the difference. I was going to mail the HD receiver I thought I owned back and go with Comcast or Charter. Well, a couple more bombs hit me even harder than the 1st two.

The 3rd bomb was that a new 2 year contract was slapped onto my account when ?I? purchased my own receiver. Re read that? when I PURCHASED MY OWN RECEVIER. WHAT THE HELL?

Oh, don?t laugh, it gets better. I figure, ok? I can take my receiver and pay the $275 early contract termination fee with whatever I can get on ebay for a 2 month old HD DVR. That?s when bomb #4 hits. Sir, you don?t own that receiver. Huh? The receiver I dropped $299 for at Circuit City. I don?t own it? Nope. I don?t. You paid for the right to lease the receiver to use on Direct TV. That?s kind of funny. I go buy myself a Nokia N95 (an unlocked GSM Cellphone) to use on Cingular/AT&T network, they don?t up my contract and tell me that they own my phone do they?

So, to sum it up. I owe $337 to Direct TV. I can reduce this by $240 for sending a $99 market value HD Receiver than I BELIEVE I own based on the ad I accepted to get HD service. No Problem. I guess I can send this thing back againt my will. (not that I am using it anyway) Then, I cancel my account and pay them $275. Instead of recovering some of the cost of this fee by selling the HD DVR I paid for outright, I will have to send that receiver to them too. Yes, send the receiver I paid $299 cash for to DIRECT TV. No refund for my $299, no nothing.

What a load of crap. Who governs this companies tariffed rates? The PSC, FCC, who? Think it?s the FCC?

Update: The guy that called me a few hours after my letter was sent to the CEO was very thorough in explaining how I was screwed. Here are the bullet points.

  • The “Free” with install HD Receiver apparently came with small print about leasing that I didn’t read. So I have agreed to return the HD receiver. (not like I was using it anyhow, it’s got a dust wrapper already.
  • MY HD DVR isn’t mine. Once again, I didn’t read. Before I explain, let me just ask. How many of you would expect to pay $299 for this thing and expect it not to be yours without reading the “box”. I expected it to be like any other piece of A/V equipment I have bought. I am going to be severely pissed if Onkyo comes back asking for their $900 receiver if I stop using it. Anyhow, the $299 is a subsidized price. Similar to buying an AT&T Tilt for $299 instead of $600. Only you know this walking into the AT&T store.

I am going to let them come out and fix my reception issues and give them another chance. I might as well since I would have to pay $275 to quit since I was screwed into another 2 year contract when I bought a $299 subsidized receiver. What crap. Anyhow, since it’s subsidized, I can’t even sell the damn thing to recover the $299.

Yes, I am happy for a great explanation, but I am still unhappy that companies can get away with screwing consumers over with contracts. The FCC needs to step in and throw some regulation on this.  Subsidized or not, I am adding over $12 a month to their pocket by getting this DVR before they rope me in with an extra 11 months from when my contract was to expire.

Moral of the Story… READ THE FREAKING BOX (or paperwork) My advice, stay away from companies that take advantage of those that don’t read the FREAKING BOX.

I will not enter into any other contract with this company. I don’t care if they give me a 52″ LCD, no go! (not to mention, they would give it to me, then charge a lease fee and ask for it back if I don’t use it for 2 years.)

Thanks for explaining this Chris, but I have to agree to disagree on the business ethics of these moves. (my lack of reading or not)

    Wanted to let everyone know that I can that there is a phone number for the president of direct TV. I called it and seems to maybe help. time will tell . 1-800-666-4388 If they would just stop lying , cheating , and stealing life would be so much simpler

    these mother suckers told me i was goin to get internet and the direct tv for 80$ they come set up cable i get home and i have no internet o k i ask my roomate where it is she say i will get my modem in the mail. so i wait a few DAYS AND I GET A BILL for 80$ i still don t have internet so why should i pay the full price and why am i getting a freaking bill so quick this makes no sence so i call talk to a stupid operator for like 20 min and get no where except direct tv bills a month in advanc e well news to me i ask for a stupervisor and she tells me i didnt order internet well i say oh yes i did i wouldnt have changed to ur service if i wasnt getting a better deal from my other provider so she says you did not order internet and u signed a 2 year contract if u break it u pay 400 $ im livid and feel like i got raped with no vasiline i going to write corprate on the matter because i wae led to believe i was getting something that i was not and that is bs

    I took was told that I would have to pay an early cancellation fee of $70.00. The they took out $254.40 out of my account. Now my mortgage check is going to bounce. I am just trying to make it thru these hard times and Direct TV is putting the nail in the coffin!!!
    Please someone start a class action lawsuit against this company...there are many who will join!!!!!!

    Bought HD TV and Direct wants me to pay for two new receivers? You would think w/broadcast going HD, rather than Direct TV milking their customers for more money, they'd provide equipment needed to keep up with the times. contract up in December and can't wait to cancel and move onto more reputable, honest, customer friendly provider. I'm all for a class action law suit. Looking to see if one was filed is how I happened across this comment page. Will continue to look in hopes of...... I expect this company is making much profit in the way they charge for service, receivers, hidden charges, etc. Would be willing to bet they've got a heafty "bonus" income from customers cancelling their contract prior to term, paying huge cancellation charges, out of frustration.

    Not even two months and they lied to us big time! They charged us for everything and even though we did this "rebate" thing, claim we have to pay $70 a month instead of $34.99 because "we did not send in a rebate." Yet the contract and ads, say NOTHING about a rebate. This is illegal.

    Overcharging and lying is a felony!

    We need to band together and sue DIrect TV. I see some lawyers in DC already are...

    Let's get some of our money back before they go out of business.

    Direct Tv is an incredibly "bug infested" entertainment system. If you are used to turning the
    TV on and watching it, then Direct TV will give you a new perspective. They have good customer service because...well...they have to. I have multiple receivers in my house, and have had a variety of problems. I like to read, so it has worked out. Recommend Russian novels as they will occupy you for several days.

    Since i have let out this number to call 310 964 5000, i was told that my old closed down account will be charged $5.00 if anyone calls in a complaint. How can they threaten lijke that . they are customer service and are there for free???? Help I am being hijacked. STAY AWAY FROM DIRECT TV.. YOU WILL BE SORRY YEARS LATER.

    Bombard the office of the president with calls. These people can change things but they will not change a thing. So Everyone do not call customer service call this number, ask the operator for the office of the president. You do not get the office of the president but a boiler room full of managers who have the abaility to do somethnig but never will. Just bug the hell out of them! 310-964-5000.

    I don't want to repeat the same thing that has already been said. I despise this company. I refuse to pay an early termination fee and will cancel after I'm done with my one year that's left in my contract. If law suit contact me!!!!

    Wow...Thank god I stumbled on this website. I'm desparately trying to get rid of Comcast because they are not much better...so who else is out there? Somebody has to give Comcast a good run for their money. I hate them too.....

    Same exact thing happend to me. They want $425 for early disconnection fees. My neighbor dropped DirectTV but gave me a brand new HD receiver. When they activated it they extended my contract two more years. Of course they didn't tell me this but it was probably on the box somewhere in small print. This is such terribly bad business. No wonder companies are going under. I'm going to try Verizon Fios but if they appear dishonest then fuck TV I'm serious. We are probably better off for it.

    I had direct TV installed March 08, cancelled March 09. They said that I owed them $269 for an "early cancellation fee" because I did not keep the service for two years and because I had a DVR. They said that the DVR installation increased my commitment to two years from one year. I was never told, nor ever signed anything that would agree to this increase in commitment, nor could they provide any proof that they told me.

    Then, 15 days after they sent me the "early cancellation fee" bill, they have already sent it to a collection agency.

    Unethical greedy corporate bastards. Let's take their top management out of their Connecticut sixteen bedroom mansions and put them in jail. For life. Of course that will never happen, it never happens, the little guy just gets screwed once again with absolutely no personal responsibility imposed on these jerks.

    Sue them for all they are worth. Of course a class action suit will only make the lawyers rich, we will never see more than fifty cents if they settle it. Where is the outrage?

    Sorry about it seems that Direct TV and similar companies are having terrible practices against consumers. I had similar problem with an extend 2 years contract due to the use of a new HD receiver. I was not aware of this so i call DTV customer support and they let me know that it was a verbal agreement wich I never recall maybe am getting older an I forget about it !!. I am in the process to submit an small claim about this hidden contract as well as the constant fail in receiving good signal. Beside that I had a couple of TV sets which were damages due to bad installation procedures (no grounded) they accept the damages I sent them pictures of the TVs and DTV technitians confirmed the installation problem. I did follow all procedures it pass almost 2 years I never get my refund.
    To end my history I moved to Cablevision to find out that they also have hidden details an unfair billing practice... What is going on with this companies?

    What they don't tell you is that the minute you plug in the DVR, your contract gets extended. If there's a power outage in your area, your contract gets extended. Everytime you turn your TV on, your contract gets extended. If you move your TV into another room, you contract gets....what? EXTENDED! If the wind blows, if it rains, if it snows, if a bird lands on your windowsill, if you eat a cheese sandwich on Thursday, if a meteorite falls in the desert----YOUR CONTRACT GETS EXTENDED. Moral of this story: once you sign on with Direct TV, you will die with Direct TV. I think this is called kidnapping? Lying? Fraud? Against the law? But, which law? Theirs, of course. My contract was extended after 7 years with them when I sneezed on the phone with a rep. I now am beholding to them for another 24 months. How far is it to Cuba? No Direct TV, right?

    I had the same problem with Direct tv. Installation wasn't grounded and it destroyed a three year old LCD set and a brand new one (purchased before we knew the problem) the same day. That was a month ago and now after 6 years of service, they not only don't own up to any responsibility, they are charging me an early termination fee. They restarted a 2 year contract without my knowledge and now I owe $425.00 for early cancelation. I must have been rendered unconscienous and somewhere signed a contract in blood with the devil.

    After cancelling my service they read the cards on my boxes and supposedly I had order about $100 in PPV movies that I had never been previously billed for. Some going back almost 2 years ago.. I had bocks on all the boxes on my tv preventing anyone from ordering PPV channels but now I am being billed for movies that were retrieved from the cards on the boxes.

    I FEEL YOUR PAIN I HAD A HD TIVO AND HAD A DIRECT TV REP INSTALL A NEW REVEIVER AND STOLE MY RECIEVER WHICH I PAID 660.00 AND DIRECT TV DENIED I EVERY OWNED IT AND REFUSE TO GIVE IT BACK AND MY NEW 21 RECIEVER SUCKS

    My issue was not as big, but defiantly have issues with the deceptions. I purchased receivers off ebay so I can avoid a "leasing fee" on my bill, come to find its NOT a leasing fee, now i'm stuck with them for another year.

    I got one for ya had a romate move in with me and he wanted an HD DVR in his room so he purchased one on his own and i hooked it up on my account lived with me a few months then dissides to movwe out well he takes his dvr witch i seen no prob. with that so i disconnect few weeks later i recieve a empty box telling me to return the reciever ? i told them the story that i did not purchase the dvr and it was a roommate that moved out after being on hold for over 30 min. they told me im responsible for the reciever well all i can say now! is that im not done with them yet!!!!

    This last wednesday, I ordered DirectTV. It was a deal that said I could lock in the price for 12 months. Everywhere I looked it was 12 months. I was signing up online and never once does it mention equipment lease, or contract length, but again, everything was noting the 12 months. Well, the installer showed up today installed everything and then handed me a 24 month contract. I told him it was supposed to be 12 months like the website said. So, he said "no Biggie" and I didn't have to sign. After he left, I called Direct TV and talked to a CSR and the manager. They confirmed it was for 24 months because I was supposedly leasing the reciever. I tried to get them to work with me for 12 months, which I was willing to do, but they weren't. I cancelled the service and told them to come get their stuff. They're sending me a return kit and disconnecting me at midnight tonight. They would rather me throw away the dish and send them the recievers back than have me as a customer.

    I even told them that I've had cable for years after the initial 12 month contract and that If they provided good service I would likely do the same with them. I just didn't want to commit to 24 months.
    I feel they deliberately advertise the 12 months just to bait customers, then switch to 24 month contract. It took the CSR 20 minutes to find a reference to the 24 month term and it was in the "About Us" link. Bunch of crooks.

    my problem just resonates with this letter imyself fell victim to the same wonderful servises of this company. i'm now feling i've been stiffed ,cheated ,misinformed and unrepresented the later being the worst part. after spending a couple of hours on the phone with these merciless (i need another word for people human beings just will not do)............ being told one thing then another then another... while my government that i've worked for state and federal my husband veitnam,indo-china and vfw member, this is how our reps and sens allow us to be treated IN THIS ECONOMY god bless america,because the FCC dont give a ---or this condition could not exsist, dont be niave theres a reason for all of this$$$$$$$$$$$$$$
  • We had problems immediately after installation. When I placed the order I told the girl I wanted exactly the setup we had with Comcast, which was HDTV box (with TIVO like capabilities) in my husband's bedroom and a plain box in the living room. She took down my order, we went over the package prices and she was very pleasant. When installation was done, we got our signal and I signed the paper (I felt the installers were rushing to get out of there to go to lunch or something). They did tell me that it was not an HDTV box but when I told them that's what I'd asked for, they said it would be a separate service call, so I signed the paper (requested HDTV box; did not receive) so they'd know it was "under protest." When I called to set up another visit the woman on the phone was rude and ugly unlike the other woman and when I learned they couldn't come back to do that install for several weeks, I said, never mind, let's just cancel the contract and we'll go back to Comcast. She said it would cost us hella money to "break" the contract and I informed her that THEY breached the contract by failing to provide the services I'd purchased. She told me the HDTV box was hundreds of dollars more (I would have remembered if I'd been told that when placing the initial order); and I told her I was told no such thing when placing my order. I asked to be transferred to a higher up and received a nice gentleman who told me a totally different story, agreed to knock the price of the upgrade down to $50 rather than the $299 that idiot woman was trying to charge and got someone out there within days, not weeks. So you just have to know how to bitch and whine and moan, something that comes naturally to me. We pay our bills on time and have had wonderful service since that time so I hope that continues.

    I also have been (what should be illegal) screwed over by deceptive sales practices by Direct TV. We the people should begin a class action lawsuit against this company and there missleading and deceptive practices, Heres my lastest direct tv calamity story. I had there service before for many years without any major incidents. Then I had a bad receiver issue, couldn't get pay per views to work on there receiver. I called them for SERVICE and they told me , yes we confirm that your recevier box is bad and you need to pay us to send you another one. Wait a minute, did you say pay, yes they said you have to pay us for us to send you another one, as thats the deal. I said I pay you a monthly fee for this and ????. I cancelled as they would not repalce THERE bad one unless I paid! I went to cable (time warner) and was dissapointed with its signal quailty and then, after moving over I started to get bombarded with Direct TV free this and that promotions to come back,and the deals got better and better month after month. So I decided to give them another chance and resigned for there (best deal) and had 2 hd and 2 regular receivers installed. All went well, as the (SUBCONTRACTED) installers, really knew there stuff and did a great job overall, new dish, new receivers etc etc. About 6 -9 months go by and I decide to add another hd flat screen to my sons room? I call to order an UPGRADE to a HD receiver. She says that will be 299.00 Jane??? I said what??? Yes that will be 299.00 upfront and of course an additional monthly fee. I am again asking myself , he we go again, I feel like I'm being screwed again, but decide to go for it. They send the receiver to my home(do it yourself?), in a box with minimal instructions?? I don't do this stuff, so I call a friend who understands how to basically do this change. He calls in to Directs online techs to do the install, go's through the process and theres no HD??? He says well you got the B converter hooked up? My friend says what B converter, oh the one that connects to the line and back of the hd receiver??? Oh Ihe said where would I find it?? Oh it comes in the box with the receiver, he says we did not get any b converter in the box, only the receiver and basic instructions, remote . He says well you can't get any hd without this. My friend says , please send this so I can put it on and solve the problem. By the way the other two hd systems are working fine. They send two of the B converters and my friend installs one and still no HD?? He calls in to the tech support dept again and go's though another entire set up of the unit. Still no HD service, only the standard service as before?? he is told to change the B converter out and put the second one on that came. Restarts and still no HD service. The tech girl says well it must be the incoming line is bad (no signal)or it could be the dish needs alignment, or possible a bad receiver etc etc. Well my first logical question is , can you please send a service agent out to look at it and determine whats whats? The tech says well that will cost you 50.00 and an additional montly charge of 4.95 and we will send some one in the next week or so. I said, this is a new receiver, it should work and why do i have to pay for service on a new product I paid for in advance??(ie: consumer warranty)protection act) Sorry, You have to pay for this service etc etc?? Are you kidding i said, he we go again, this is why I left you before and know you locked me into a 299.00 upfront charge, additional one year extension of my contract etc etc , just to do a basic upgrade etc etc??? Its not working!! Unbeleiveable. I find it hard to fathom that a company thats under some sort of FCC regulation can do this sort of entrapement sales BS on a dailey basis. I asked the tech, do you have a service and support group, yes she says and we subcontract it , and we pay them $100. bucks for a service call? I said well you want me to pay 50.00 for a call and then another montly 4.95 adder for the life of my contract and your subcontracter will determine if I have a bad cable or receiver? Yes they reply, thats how it works, I said well if its the cable, you put it in and it needs to be replced, well sir thats only gauranteed for 90 days after install?? your receiver could also be bad and thats how we do it, but you have to pay or 50.00 fee, and monthly adder or the tech says (IS THERE ANYTHING ELSE I CAN ASSIST YOU WITH TODAY?? I was pissed ! This is the exact manner in which they talk to you and handle service to a existing customer??? Are you kidding, I wouldn't have ANY customers in my world if i did business in this manner, let alone it basically should be illegal. Obviously there sales and tech support people a trained and told to do business in this manner. ADDERS ADDERS and more Adders. Recently I had Verizon fios internet service installed in my home (top quality serviceand system) and will immediately look into what and when they can install there fios tv service for me and the hell with Direct TV, no more rainouts, snow on my dish, blocking signals and paying for additonal nothing while being openly screwed and overall being treated like a piece of shit while paying and paying more and more along with having zero on site support along with continued unending abuse. I would like to talk to you all who have had these experiences and we should join together and seek to commence a class action lawsuit against there missleading and illegal business practices. The only saving grace is that verizon is on board in our town and bundling very competivie deals with there new fios fiber optics tv network, which is full hd 1080P capable which Direct is only 1080i, so its a no brainer to make the switch, one call, there own on site service group, bundled, phone, internet, cell and tv services deals and most of all honest , polite business practices. Oh by the way, another Direct TV exclusive is the if you don't pay us for all of our fees on fees BS we will ruin your credit with submitting you for collection. This is why direct tv needs to be sued for these unethical and illegal business practices.
    I am sure there are ennough of us that have experienced this and been cheated and want action against them. There is a law firm out there that can run with this and make a bundle on it. If your reading this please, lets get them for this illegal business practice and methodology. To all considering DTV service, please read the thousands of other reports like mine and buyer beware as we have all had the same treatment and results.
